I'd say at minimum 15 million gun owners.

American gun owners outnumber the military by 6,290,210
They don't have the hardware but do have the skills and the numbers. Don't forget many Soldiers are hunters and their parents/children/relatives are hunters and gun owners.
This will split the military into two camps against each other.

For a nation founded on property and individual rights it's rather interesting that one of President Washington's more important acts was to lead an army (militia) to put down the Whiskey Rebellion. It's worth pointing out political discord, and from 1791 to 1794 violent armed rebellion, didn't really expand along with the power of the Federal government. Indeed the nation was founded by armed violent political discord and I'd suggest this only started to trend downward in the 1970's.
ReplyDeleteAssuming a state or Congress passed significant gun restrictions I'd be extremely curious to see how this US Supreme Court would rule given it's recent 2nd Amendment rulings. Look at Heller (2008) where the court threw out the DC ban on handguns and stated clearly that the 2nd Amendment is a right to bear arms having nothing whatsoever to do with a militia. In 2010 in McDonald the court ruled that the 2nd Amendment protects one's right to bear arms against state law exactly the same as Federal.
GREAT ARGUMENTS. but i need to point out that Obama's gonna get a chance to MAYBE stack the court if a couple of justices retire.
DeleteQuite true but I tend to doubt that means Heller is overturned. They don't like over turning precedent. It's exactly why Scalia has said repeatedly that Roe v Wade was not going to be overturned. Both cases in one respect are instructive in that the Court defined (some would say created) a basic Constitutional right where none was clearly understood prior.
ReplyDeleteObviously prior to Heller tens of millions of Americans believe the 2nd Amendment gave them an individual right to bear arms but the court had prior to 2008 left this ambiguous (under constitutional law). Now the Court has said it's an individual right having nothing whatsoever to do with a militia. It's explicit now, just like the right to privacy.
Personally I rather doubt most advocating serious gun restrictions actually understood the Constitutional limitations they have to operate under.
